Terms of Service

Please read these Terms of Service carefully before using the Undisputed application operated by Tiny Whale and Petunia.

1. Acceptance of Terms

By downloading, installing, or using Undisputed, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the app.

2. Description of Service

Undisputed is a personal health journaling application that allows users to log symptoms, document medical appointments, and maintain a personal health record. It is intended as a personal record-keeping tool only.

3. Not Medical Advice

Undisputed is not a medical device and does not provide medical advice, diagnosis, or treatment. The information you record is for your personal reference only. Always consult a qualified healthcare professional for medical guidance. Never disregard professional medical advice or delay seeking it because of something you recorded or read in this app.

4. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at info@tinywhaleandpetunia.com if you suspect unauthorized use.

5. Your Data

You own your health data. We do not sell, rent, or share your personal health information with third parties for commercial purposes. See our Privacy Policy for full details on how we handle your data.

6. Acceptable Use

You agree not to:

• Use the app for any unlawful purpose
• Attempt to reverse engineer, decompile, or disassemble the app
• Use the app in any way that could damage or impair its operation
• Share your account credentials with others

7. Subscription and Billing

Undisputed offers a free tier and a paid Pro subscription. Subscription fees are billed monthly or annually as selected. You may cancel at any time; cancellations take effect at the end of the current billing period. We reserve the right to change pricing with 30 days advance notice to existing subscribers.

8. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time through the app settings. Upon deletion, your data will be removed from our systems within 30 days, except where retention is required by law.

9. Disclaimers and Limitation of Liability

The app is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Tiny Whale and Petunia shall not be liable for any indirect, incidental, or consequential damages arising from your use of the app.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via email or in-app notification. Continued use of the app after changes constitutes acceptance of the new Terms.

11. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
